BitMEX is facing a proposed class action in the U.S. District Court for the Southern District of New York, after BKX Services Inc. and David Namdar filed suit on July 24 alleging the exchange's internal trading team manipulated BitMEX's liquidation mechanism to unlawfully capture customers' Bitcoin, Cointelegraph reported.
The complaint says the two plaintiffs together lost 622.66 BTC, including at least 305.81 BTC for BKX and more than 316.85 BTC for Namdar. They are seeking the return of the Bitcoin as well as damages on behalf of all U.S. users who have purchased BTC swap products since July 23, 2018.
The filing coincided with an announcement from BitMEX parent HDR Global Trading that it plans to cease operations on Sept. 23. Following the disclosure, the BMEX token fell about 90%.
